Britney Spears’ parents, Lynne and James, are claiming their daughter is “mentally incapable” of testifying in the defamation case they brought against her ex-manager Sam Lutfi, the Huffington Post is reporting. Lynne and James are also claiming that Lutfi used to drug and harass her after her break-down.

But Lufti is questioning the validity of the Spears’ claim. He had an expert analyze the singer during her recent interview with Ryan Seacrest and her latest MTV documentary. The expert said Spears looked more than capable of testifying in court.

In the interview with Seacrest, the expert said Spears “is interviewed at length, and she responds logically and coherently to questions, evidencing logical thinking and mental competency.” The expert added that the MTV documentary also proved the singer’s mental competence. “In my opinion, there is good cause to conduct an Independent Medical Examination to investigate the Conservators’ claim that Ms. Spears is not mentally capable of testifying,” the expert added.
