The three lawsuits include major Aereo investor and IAC chief Barry Diller suing David for creating BarryDriller.com last year. This February saw David suing Aereo for trademark infringement after he acquired the naming rights to a product called Aero. Finally, in March, Aereo sued David for creating Aero.tv. Alki David’s streaming video service Aereokiller has gained support from digital rights group Electronic Frontier Foundation. According to MediaPost’s Online Media Daily, the group filed a friend-of-the-court brief arguing that the injunction held against Aereokiller to broadcast television programming should be lifted. The EFF states that television networks shouldn’t be able to “regulate personal, everyday uses of free television broadcasts.” The group also states that it’s nonsensical for Aereo to be legal in New York, when Aereokiller, which is basically the same type of service, is illegal in California. Both Aereo and Aereokiller offer subscribers streaming over-the-air broadcast channels to their digital devices in exchange for a fee. However, television  [ Read More ]

There’s more to discuss concerning FilmOn’s Alki David and his Aereo/Aero court case. According to The Hollywood Reporter, a California judge has denied without prejudice Aereo’s motion for a temporary restraining order against David and his use of Aero. The trademark infringement lawsuit, which was filed last week, contains Aereo’s opinion on the matter. “The public’s opinion, attitude and impression of Aereo will likely be irreparably harmed by Defendants’ unauthorized services or advertising in such circumstances,” the motion states. The motion goes on to say that harm to Aereo will increase each day “misconduct” is permitted to continue. Aereo, owned by FilmOn competitor Barry Diller, can try for a motion  [ Read More ]
