California Legalizes Swissx and Similar Hemp CBD Products For Retail Sale

The use of CBD in dietary supplements, foods, beverages and cosmetics has been legalized in California, after Gov. Gavin Newsom signed AB 45 into law. The law was passed last month, following a three-year process of being analyzed by the state legislature.

The passing of AB 45 also comes after California became the first state to legalize medical marijuana in 1996, and then legalized recreational marijuana in 2016. The recent legalization of hemp and CBD in California comes after lawmakers previously contemplated the bill in 2014 and 2018.

AB 45 is also notable for removing much of the risk of legal consequences for brands and retail outlets that want to sell CBD. But before that can happen, the California Department of Public Health (DPH) is setting out to develop regulations around the sale of CBD-infused products at stores, which is expected to take several months.

The new law will also require labels on CBD-infused products to include certain warning statements. The labels must also feature a scannable barcode, website or QR code that’s linked to a certificate of analysis that provides specific testing information.
