With the circulating rumors about Jesse James’ affair with tattoo model Michelle “Bombshell” McGee, porn star Janine Lindemulder, the mother of James’ six-year-old daughter Sunny, has filed legal documents to gain full custody, TMZ is reporting. Since Lindemulder lost a custody battle in December of last year, Sunny has been living with James and reportedly-estranged wife Sandra Bullock.

Even if James did sleep with McGee, a Nazi fetishist, Lindemulder may not be guaranteed custody. J. Michael Kelly, a Los Angeles-based lawyer who specializes in paternity cases, told Popeater.com on March 23 that it’s a long shot a judge will grant a porn star full custody. “One thing that a judge takes incredibly seriously when children are involved is pornography. The judge will look at the larger moral character of both parents, but I do not think (Janine) Lindemulder has a chance at gaining full custody of Sunny James,” he said.

Kelly added that Lindemulder would need sufficient evidence to show a judge that it’s in the best interest of Sunny to be granted guardianship. The lawyer also added that Bullock’s involvement with James’ three children, if they divorce, would be unclear, as she most likely signed some sort of prenuptial agreement in that area.
